PERSONAL DATA PROTECTION

Every entrepreneur, whether he wants it or not, collects personal data. What is more, he not only collects, but also modifies, stores, changes, makes available, and entrusts the personal data of employees, contractors, website users, newsletter recipients, etc., to the company. On 25 May 2018, the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC is effective in the national law of the Member States. These provisions strengthened the Privacy by Design and Privacy by Default principles, which have not yet had their equivalent in national legislation.

We offer:

  • current status audits and reports with proposals for possible solutions Determination of areas of personal data processing, analysis of existing documentation, and physical protection of personal data are extremely important, and at the same time are the beginning of possible changes in the scope of actual data protection.
  • support in developing and updating documentation related to personal data processing Proper preparation of the Security Policy and IT System Management Instruction is half of the success in the protection of personal data in the company. While at present the principles of documentation preparation are described in the Regulation of the Minister of Internal Affairs and Administration of 29 April 2004, since 25 May 2018 the entrepreneur is obliged to construct documents in a very component manner, resulting in the proper protection of personal data.
  • support in transferring data to a third country (outside the EU) Gathering personal data, we often send them abroad. Transferring them to EU countries does not pose any major risks, but sending them to third countries may be problematic. We assess and assist in the preparation of appropriate documentation.
  • advice on drafting a privacy policy and regulations related to the website Nowadays, there is probably no entity that would not run a website. Depending on the mechanisms used on the website, we will prepare documentation tailored to the needs, containing the necessary information, and tailored to the requirements of Clients. • training for staff in the field of personal data protection The weakest link in personal data protection is employees who are not aware of the many risks that the Personal Data Administrator is responsible for preventing. We will help you to conduct practical workshops aimed at increasing the awareness of people working for our Clients.
  • ongoing substantive support for Personal Data Administrators and providing opinions on their processing processes We are available on a daily basis to solve current problematic issues that concern Personal Data Administrators. We support legally the Information Security Inspectors appointed in your companies.
  • representing the Client in court proceedings in matters relating to the broadly understood protection of personal data At present, court disputes are not a common phenomenon in the field of personal data protection. However, we anticipate that the change of regulations in 2018, giving the possibility of a direct application for compensation against the Personal Data Administrator by a natural person, will result in an increase in the number of cases in which Clients will need professional support.
