PUBLIC PROCUREMENT LAW
Public procurement law is an extremely important area of law concerning procedures for spending public funds, which covers issues related to public procurement procedures, their performance, the consequences of non-performance or improper performance, control of awarded contracts and the discipline of public finance. For years, the Law Firm has been advising both entities awarding public contracts (within the scope of awarding contracts) and contractors (within the scope of obtaining contracts).
We offer:
- comprehensive advice to the Contracting Authority/Entity including: legal assistance in selecting the optimal procedure for awarding a public contract, preparation / verification of tender documentation, ToR, essential provisions of the contract / draft contracts, legal support in taking action in the course of the public procurement procedure;
- comprehensive advice to the Contractor including, among other matters: legal assistance in preparing a bid in a public procurement procedure, analysis of tender documentation for the needs of the Contractor (including essential provisions of the contract/ draft contracts), ongoing legal support in the course of the public procurement procedure, analysis of the legitimacy of bringing legal remedies, and drafting such remedies (appeals, complaints).
- opinions, expert opinions and consultations, providing advice and explanations in the area of public procurement law
- representation (contracting authority/contractor) in proceedings before the National Chamber of Appeal (KIO) of the President of the Public Procurement Office and courts in matters relating to the award of public contracts.
